শর্তাবলী

HONEDGER ওয়েবসাইট (honedger.com), Android অ্যাপ ও Telegram বটের মাধ্যমে AI-ভিত্তিক শিক্ষা ও কাজের সহায়ক সেবা দেয়। অ্যাকাউন্ট খুলে, "সম্মত" চিহ্ন দিয়ে বা সেবা ব্যবহার করে আপনি এই শর্তাবলী, আমাদের গোপনীয়তা নীতি ও রিফান্ড নীতি মেনে নিচ্ছেন। এগুলো মিলে আপনার ও HONEDGER-এর মধ্যে চুক্তি (চুক্তি আইন, ১৮৭২ ও তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০০৬ অনুযায়ী ইলেকট্রনিক চুক্তি)।

১. কারা ব্যবহার করতে পারবেন

• ১৮ বছর বা তার বেশি বয়সী যে কেউ নিজের নামে অ্যাকাউন্ট খুলতে পারবেন।
• ১৮ বছরের কম বয়সী শিক্ষার্থী অভিভাবক বা আইনগত অভিভাবকের জ্ঞাতসারে ও সম্মতিতে ব্যবহার করবে। অপ্রাপ্তবয়স্কের পক্ষে পেমেন্ট ও সম্মতি অভিভাবক দেবেন, এবং চুক্তির পক্ষ হবেন অভিভাবক। অপ্রাপ্তবয়স্কের তথ্য দিয়ে আমরা বিজ্ঞাপন, প্রোফাইলিং বা লক্ষ্যভিত্তিক প্রচার করি না।
• শিক্ষা-প্রতিষ্ঠান বা টিউটরের কোড দিয়ে যুক্ত শিক্ষার্থীর ক্ষেত্রে প্রতিষ্ঠান/টিউটর নিশ্চিত করবেন যে অভিভাবকের সম্মতি নেওয়া হয়েছে।
• সঠিক তথ্য দেবেন এবং নিজের পাসওয়ার্ড গোপন রাখবেন। আপনার অ্যাকাউন্টে যা হয় তার দায় আপনার।

২. সেবা কী, কী নয়

• HONEDGER পাঠ, নোট, প্রশ্ন, কুইজ, পাঠ-পরিকল্পনা, প্রশ্নপত্র, চ্যাট-উত্তর ইত্যাদি কৃত্রিম বুদ্ধিমত্তা (AI) দিয়ে তৈরি করে। আমরা মান-যাচাই করি, তবু AI ভুল করতে পারে। পরীক্ষা, ভর্তি বা গুরুত্বপূর্ণ সিদ্ধান্তের আগে পাঠ্যবই, শিক্ষক বা নির্ভরযোগ্য উৎসে মিলিয়ে নিন।
• HONEDGER শিক্ষকের বিকল্প নয়, এবং চিকিৎসা, আইনি, আর্থিক বা বিনিয়োগ পরামর্শ দেয় না।
• NCTB-এর পাঠ্যবই ও বোর্ডের প্রশ্নের স্বত্ব তাদের নিজ নিজ মালিকের। আমরা বিষয়বস্তুর নিজস্ব ভাষায় ব্যাখ্যা দিই। কোনো স্বত্বাধিকারী আপত্তি জানালে আমরা দ্রুত বিষয়টি দেখি ও প্রয়োজনে সরিয়ে নিই (দেখুন ধারা ১০)।
• ট্রেডিং-সংক্রান্ত কোনো ফিচার বাংলাদেশে চালু নয়; যেখানে আইনসম্মত শুধু সেখানেই, আমন্ত্রণের ভিত্তিতে।

৩. প্যাকেজ, ফ্রি স্তর ও ন্যায্য ব্যবহার

• ফ্রি স্তর: সীমিত দৈনিক চ্যাট, আগে-তৈরি কনটেন্ট এবং প্রতিটি টুলে মাসে নির্দিষ্টসংখ্যক নমুনা। ফ্রি সেবা চলে সাশ্রয়ী মডেলে, এবং সবার মোট দৈনিক ফ্রি-বরাদ্দ শেষ হলে সেদিনের মতো সাময়িক বন্ধ থাকতে পারে। ফ্রি সেবা "যেমন আছে" ভিত্তিতে, এর জন্য কোনো নিশ্চয়তা বা ক্ষতিপূরণ নেই।
• পেইড প্যাকেজ: প্রতিটি প্যাকেজের দাম, মেয়াদ ও সীমা কেনার আগে ওয়েবসাইট/অ্যাপে দেখানো হয়। দাম বাংলাদেশি টাকায় এবং প্রযোজ্য সব চার্জসহ দেখানো হয়।
• অস্বাভাবিক বা স্বয়ংক্রিয় (bot/script) ব্যবহার, অ্যাকাউন্ট ভাগাভাগি বা বিক্রি, কিংবা সিস্টেমের ক্ষতি করে এমন ব্যবহার আমরা সীমিত বা বন্ধ করতে পারি।

৪. পেমেন্ট ও নবায়ন

• পেমেন্ট নেওয়া হয় bKash ও অন্যান্য অনুমোদিত গেটওয়ের মাধ্যমে। আমরা কার্ড নম্বর, PIN বা OTP সংরক্ষণ করি না।
• পেমেন্ট সফল ও যাচাই হওয়ার পর প্যাকেজ চালু হয়। হাতে-যাচাইয়ের ক্ষেত্রে সাধারণত ২৪ ঘণ্টার মধ্যে।
• স্বয়ংক্রিয় নবায়ন নেই, যদি না আপনি আলাদাভাবে, স্পষ্টভাবে তা চালু করেন। মেয়াদ শেষে আবার পেমেন্ট না করলে অ্যাকাউন্ট ফ্রি স্তরে ফিরে যায়, আপনার তৈরি ফাইল মুছে যায় না।
• দাম বদলালে আগাম জানানো হবে। চলতি মেয়াদের দাম বদলায় না।
• টাকা ফেরতের নিয়ম রিফান্ড নীতি-তে।

৫. প্রতিষ্ঠান ও টিউটর অ্যাকাউন্ট

• প্রতিষ্ঠান/টিউটর তাদের শিক্ষক ও শিক্ষার্থীদের তথ্যের ব্যাপারে দায়িত্বশীল থাকবেন, শুধু শিক্ষা-কাজে ব্যবহার করবেন, এবং আমাদের গোপনীয়তা নীতি মেনে চলবেন।
• প্রতিষ্ঠানের সঙ্গে আলাদা লিখিত চুক্তি থাকলে সেই চুক্তি এই শর্তাবলীর ওপর অগ্রাধিকার পাবে।

৬. আপনার কনটেন্ট

• আপনি যা পাঠান (প্রশ্ন, ছবি, ভয়েস, ফাইল) তার মালিকানা আপনার। সেবা দেওয়ার জন্য, যেমন প্রক্রিয়া করা, সংরক্ষণ, AI সেবাদাতার কাছে পাঠানো, আপনি আমাদের সীমিত, অ-একচেটিয়া অনুমতি দিচ্ছেন।
• আপনার জন্য তৈরি আউটপুট (নোট, প্রশ্নপত্র ইত্যাদি) আপনি নিজের শিক্ষা ও পেশাগত কাজে ব্যবহার করতে পারবেন।
• আপনার ব্যক্তিগত তথ্য আমরা বিক্রি করি না। বিস্তারিত গোপনীয়তা নীতি-তে।

৭. নিষিদ্ধ ব্যবহার

• চলমান পরীক্ষায় অসদুপায়, বা অন্যের পরিচয়ে পরীক্ষা দেওয়া।
• বাংলাদেশের আইনে অবৈধ, মানহানিকর, ঘৃণা-উদ্রেককারী, অশ্লীল বা শিশুর জন্য ক্ষতিকর কনটেন্ট তৈরি বা ছড়ানো।
• অন্যের ব্যক্তিগত তথ্য অনুমতি ছাড়া আপলোড করা, কিংবা অন্যের মেধাস্বত্ব লঙ্ঘন।
• সিস্টেমে অনধিকার প্রবেশ, ভাইরাস, স্প্যাম, অতিরিক্ত অনুরোধ বা নিরাপত্তা ভাঙার চেষ্টা।
• HONEDGER-কে প্রতিযোগী সেবা বানাতে কপি বা রিভার্স-ইঞ্জিনিয়ার করা।

৮. স্থগিত ও বাতিল

• আপনি যেকোনো সময় অ্যাকাউন্ট বন্ধ ও তথ্য মোছার অনুরোধ করতে পারবেন: ডেটা মোছা।
• এই শর্ত ভাঙলে আমরা সতর্ক করতে, সাময়িক স্থগিত করতে বা অ্যাকাউন্ট বন্ধ করতে পারি। গুরুতর বা অবৈধ ক্ষেত্রে আগাম নোটিশ ছাড়াই। নিয়ম ভাঙার কারণে বন্ধ হলে রিফান্ড প্রযোজ্য নয়, তবে আইনে প্রাপ্য অধিকার বহাল থাকবে।

৯. দায়ের সীমা

• আমরা নিরবচ্ছিন্ন ও ত্রুটিমুক্ত সেবা দিতে চেষ্টা করি, কিন্তু রক্ষণাবেক্ষণ, ইন্টারনেট বা তৃতীয় পক্ষের (AI সেবাদাতা, পেমেন্ট গেটওয়ে, হোস্টিং) কারণে বিঘ্ন ঘটতে পারে।
• আইনে যতটা অনুমোদিত, HONEDGER-এর মোট দায় কোনো অবস্থাতেই দাবির আগের ৩ মাসে আপনি HONEDGER-কে যে টাকা দিয়েছেন তার বেশি হবে না। পরোক্ষ ক্ষতি, যেমন পরীক্ষার ফল, আয় বা সুযোগ হারানো, এর আওতায় নেই।
• এই সীমা প্রতারণা বা ইচ্ছাকৃত অসদাচরণের ক্ষেত্রে, কিংবা ভোক্তা-অধিকার সংরক্ষণ আইন, ২০০৯-এর অধীনে আপনার অধিকার খর্ব করে না।

১০. মেধাস্বত্ব ও অভিযোগ

HONEDGER নাম, লোগো, সফটওয়্যার ও নকশা HONEDGER-এর সম্পত্তি। আপনার স্বত্ব লঙ্ঘিত হয়েছে মনে করলে কনটেন্টের লিংক, আপনার স্বত্বের প্রমাণ ও যোগাযোগের তথ্যসহ [email protected]-এ লিখুন। আমরা ৭ কর্মদিবসের মধ্যে ব্যবস্থা জানাব।

১১. অভিযোগ ও বিরোধ নিষ্পত্তি

1. প্রথমে [email protected] বা @honedger_bot-এ জানান। আমরা ৩ কর্মদিবসের মধ্যে সাড়া দেব, আর সাধারণত ১০ কর্মদিবসের মধ্যে সমাধানের চেষ্টা করব।
2. সন্তুষ্ট না হলে আপনি জাতীয় ভোক্তা-অধিকার সংরক্ষণ অধিদপ্তর (DNCRP) বা সরকারের কেন্দ্রীয় অভিযোগ ব্যবস্থাপনা (CCMS)-এ অভিযোগ করতে পারেন।
3. এই শর্তাবলী বাংলাদেশের আইন অনুযায়ী পরিচালিত। বিরোধ বাংলাদেশের উপযুক্ত আদালতে নিষ্পত্তি হবে, যা আপনার ভোক্তা-অধিকার খর্ব করবে না।

১২. পরিবর্তন

শর্তাবলী বদলালে এই পাতায় নতুন তারিখ ও সংস্করণ দেওয়া হবে। বড় পরিবর্তন কার্যকরের অন্তত ৭ দিন আগে অ্যাপ, ইমেইল বা বটে জানানো হবে। এরপর ব্যবহার চালিয়ে গেলে নতুন শর্তে সম্মতি ধরা হবে। একমত না হলে অ্যাকাউন্ট বন্ধ করতে পারবেন, আর সেক্ষেত্রে রিফান্ড নীতি প্রযোজ্য।

১৩. অন্যান্য

কোনো ধারা অকার্যকর ঘোষিত হলে বাকিগুলো বহাল থাকবে। বাংলা ও ইংরেজি সংস্করণে অমিল হলে বাংলা সংস্করণ প্রাধান্য পাবে।

Terms of Service

HONEDGER provides AI-based learning and productivity services through honedger.com, its Android app and its Telegram bot. By creating an account, ticking "I agree" or using the service, you accept these Terms, our Privacy Policy and our Refund Policy. Together they form an electronic contract between you and HONEDGER under the Contract Act 1872 and the Information and Communication Technology Act 2006.

1. Eligibility

• Anyone aged 18 or over may open an account in their own name.
• Students under 18 must use HONEDGER with the knowledge and consent of a parent or legal guardian. The guardian gives consent and makes payment, and is the contracting party. We do not use minors' data for advertising, profiling or targeted promotion.
• Institutions and tutors who enrol students with a code confirm that guardian consent has been obtained.
• Provide accurate information and keep your password secret. You are responsible for activity on your account.

2. What the service is, and is not

• HONEDGER generates lessons, notes, questions, quizzes, lesson plans, exam papers and chat answers using artificial intelligence. We apply quality checks, but AI can make mistakes. Verify against textbooks, teachers or reliable sources before exams, admissions or important decisions.
• HONEDGER does not replace a teacher, and does not give medical, legal, financial or investment advice.
• NCTB textbooks and board questions belong to their respective owners. We provide original explanations of the subject matter, and act promptly on any rights-holder's objection (see section 10).
• No trading feature is offered in Bangladesh. Where trading features exist, they run only where lawful, and by invitation.

3. Packages, free tier and fair use

• Free tier: limited daily chats, pre-made content, and a set number of samples per tool per month. Free service runs on cost-efficient models and may pause for the day once the combined daily free allowance is used up. It is provided "as is", without warranty or compensation.
• Paid packages: price, duration and limits are shown on the website or app before purchase, in Bangladeshi Taka, inclusive of all applicable charges.
• We may limit or suspend abnormal or automated (bot/script) use, account sharing or resale, and any use that harms the system.

4. Payment and renewal

• Payments are taken through bKash and other approved gateways. We never store card numbers, PINs or OTPs.
• A package activates once payment succeeds and is verified. Manual verification usually completes within 24 hours.
• There is no automatic renewal unless you separately and explicitly switch it on. If you do not pay again at the end of the period, your account returns to the free tier and your files are kept.
• Price changes are announced in advance and never affect a period you have already paid for.
• Refunds are governed by our Refund Policy.

5. Institution and tutor accounts

Institutions and tutors are responsible for their teachers' and students' data, use it only for education, and follow our Privacy Policy. A separate written agreement with an institution prevails over these Terms.

6. Your content

You own what you submit (questions, images, voice, files). You grant us a limited, non-exclusive permission to process and store it, and to send it to AI providers, solely to provide the service. You may use outputs generated for you for your own study and professional work. We do not sell your personal data.

7. Prohibited use

• Cheating in a live exam, or sitting an exam as someone else.
• Creating or spreading content that is unlawful in Bangladesh, defamatory, hateful, obscene or harmful to children.
• Uploading others' personal data without permission, or infringing others' intellectual property.
• Unauthorised access, malware, spam, excessive requests or attempts to break security.
• Copying or reverse-engineering HONEDGER to build a competing service.

8. Suspension and termination

You may close your account and request data deletion at any time: Delete data. If you breach these Terms we may warn you, suspend or close your account, without notice in serious or unlawful cases. No refund is due for closure caused by a breach, without prejudice to your statutory rights.

9. Limitation of liability

We aim for an uninterrupted, error-free service, but maintenance, connectivity and third parties (AI providers, payment gateways, hosting) may cause disruption. To the extent the law allows, HONEDGER's total liability is capped at the amount you paid HONEDGER in the 3 months before the claim, and excludes indirect loss such as exam results, income or lost opportunity. This cap does not apply to fraud or wilful misconduct, and does not reduce your rights under the Consumer Rights Protection Act 2009.

10. Intellectual property and notices

The HONEDGER name, logo, software and design belong to HONEDGER. If you believe your rights are infringed, email [email protected] with the content link, proof of your rights and your contact details. We will respond with action taken within 7 working days.

11. Complaints and disputes

1. Contact [email protected] or @honedger_bot first. We reply within 3 working days and normally aim to resolve within 10 working days.
2. If unresolved, you may complain to the Directorate of National Consumer Rights Protection (DNCRP) or the government's Central Complaint Management System (CCMS).
3. These Terms are governed by the laws of Bangladesh. Disputes go to the competent courts of Bangladesh, without prejudice to your consumer rights.

12. Changes

When these Terms change, this page shows the new date and version. Material changes are announced at least 7 days before they take effect, through the app, email or bot. Continued use after that means acceptance. If you disagree you may close your account, and the Refund Policy applies.

13. General

If any clause is held invalid, the rest remain in force. If the Bengali and English versions differ, the Bengali version prevails.
